The difference between the roles of the prosecutor and the defense Research Paper

The difference between the roles of the prosecutor and the defense attorney - Research Paper Example This paper is a critical evaluation of the differences between the roles of a prosecutor and those of a defense attorney in the course of administrating justice. Differences in the Roles of the Prosecutor and the Defense Attorney Once a crime has been committed and brought to the attention of the prosecutor, it is his role and responsibility to ensure that justice to the victim, whether an individual or the state, is achieved by ensuring that the offender is convicted through a fair court process. To achieve this, the prosecutor embarks on a mission to create a strong case, which is free of loopholes, so as to establish whether the offender deserves to face trial or not. In this context, he has to conduct thorough investigation, which may involve questioning and securing witnesses, collecting all the incriminating evidence for example by acquiring the services of experts such as those dealing with forensics, ballistics among others, depending on the type of crime in question, so as t o support his or her case once the trial begins (Grant, 2002). This service may be provided by the investigative arm of the police, which is of high importance to the prosecutor. This is essential based on the fact that there are people in the society, who may wish to subject others to torture such that they will utilize their democratic rights to demand rogue justice through unfair means such as planting of evidence. Others may be motivated to do such things by political ambitions, whereby the prosecution may be used as a tool to discredit a person by displaying him as corrupt or inefficient. In this context, it is important to insist that a prosecutor is not always out to ensure that suspects are put to jail but also acts as an agent of truth. In fact, Rosenthal (n.d) indicates that the prosecutor has the role of ensuring that innocent people are not convicted. It is therefore the reason why he will not go ahead to prosecute a person if the evidence shows that the case is motivate d by malice. However, it is important to note that this does not imply that the prosecutor has the authority to declare one innocent as that is the prerogative of the judge, but truth be told, if the case in his hands goes to court and he does not believe in its admissibility, then, he has the powers to convince the judge by declining to persuade him to find the suspect guilty of the offences. In the US criminal justice system, the prosecutors are considered to be so powerful due to the powers vested in them, which allows prosecutorial discretion and plea bargaining. This means that they can convince the defendant to plead guilty either as charged or to a charge of lesser magnitude after which he would plead with the judge for a lighter penalty than what is recommended (Fionda, 1995). This is a circumstance that has created controversy such that critics indicate the intention of proposing mandatory prosecution instead of what is currently in operation. The international criminal cou rt (ICC), for example, is mandated through the Rome statute to prosecute perpetrators of crimes against humanity, genocide, and other war crimes, which may be perpetrated by individuals or

The Epidemic of Post-Traumatic Stress Disorder (PTSD) Essay -- Post-Tr

The human brain is extremely complex, top scientists and surgeons still struggle to comprehend how it works. The way that the brain can process information and help a person to problem solve is amazing, but another part of the brain can hold memories. Some are good--like a memory of a family vacation or of family holidays--but there are also frightening memories that can haunt a person until his or her death, if they don’t get help. For a very long time researchers have focused on combatant PTSD, for very good reason, but now a problem has risen among civilians, and they have not been focused on the growth of PTSD right here in regular everyday people’s lives. Not just soldiers can be affected; civilian men, women, and children can be affected by the things they see every day. It can be the paramedic that is first on the scene or it could be the child who watches a robbery goes wrong and a loved one is caught in the cross-fire. Either way these people are all just as im portant to the american society as the soldiers. The importance of the military is massive, and yes I agree that we should help the soldiers who suffer from PTSD, I even have my own personal connections. My uncle went to Vietnam for the Vietnam war and when he came back he was paranoid and scared of anything that reminded him of Vietnam. He like so many other soldiers then and now has PTSD from what he had seen while overseas. The only problem with helping the soldiers is that we don’t focus on the others who also need help getting through their PTSD. There are so many research projects on how to help soldiers get through their PTSD, but their are a limited amount of PTSD research papers on the civilian side. Researchers will only focus on certain things, and pr... ... 07 Dec. 2013. Exploring Cultural anthropology Essay

Cultural difference(s) is one of the research topics that best suits for a cultural anthropologist to study. In my own perspective as a cultural anthropologist, cultural difference in the United States of America is one of the topics I might propose to research. In the United States where the issue of racism is of most major concern among other races, the history of racial discrimination has passed down until today. Many races including Asians are discriminated with regards to services, priorities, socialization, and its laws. Although there are sufficient laws that suspend racial discrimination among other races, this issue will still be in existence because of each cultural differences. This study may help in understanding better cultural differences/racism where it is in existence in the whole and is at most importance to international relations. Why would you choose this culture and topic for research? I chose the culture of United States since it has been the model of every other culture in the world. Many countries are instigated to pattern their country to the United States political system, diversity in religion, economy, and culture and traditions. As a world’s sole superpower, its culture plays an important role in maintaining its political and economic power to the world. American sports in example, military tradition, and advancement in science, arts and in entertainment (Hollywood); these are the things that draws political and economic power to the United States. Its culture is of most interest by other countries in the world. With regards to racism, I chose this topic for the reason that, until today, the United States struggles in eliminating or otherwise minimized racial discrimination domestically. It is a human nature to treat other races superior or inferior among them. It is of our interest the better ways if eliminate, prevent racial discrimination among others. The study of United States culture will give better understanding what it takes to be a charismatic country and a representation to the world. The study of racism will give better understanding how will we become accustomed to other races (The Journal of American Culture, 2009). What do you hope to discover, accomplish, or address by studying this culture? How could you prepare for culture shock? The culture of the United States through careful study would lay the foundation how a developing will and/or a poor country rise to power, elevate their political and economic influence to developed countries, and improved their standard of living via instigating American culture. I’m hoping to give details on different cultures, and address the needs of other people towards information dissemination. With regards to culture shock, studying culture may help in adjusting and/or adapt to culture differences. References â€Å"The Journal of American Culture. † American Family Traditions, (2009). Mr. Cook Makes A Strong Case - 2184 Words

Mr. Cook makes a strong case in his attempt to understand the causes and contributing factors behind the segregation along race, class and gender lines which were so prevalent in British ruled India, but also strictly observed within Britain and her other colonies. In â€Å"Conflicting Ideologies in British India, 1875-1900† he cites factors both specific to India, in particular the suppressed revolt of 1857, and those more external, like the â€Å"hardening racism† in Europe. The substantial losses, both financial and in human lives, associated with the revolt of 1857 resulted in a significant decline in trust and an increasing hesitancy to risk â€Å"antagonizing Indian sensibilities†. Since the revolt was viewed as retaliation for British attempts to Westernize India, this fearful reluctance to continue along the path previously envisioned by some which ultimately resulted in Britain’s empowerment, modernization and civilizing of the native Indians t o a place of independent governance and administration, became less appealing but also served as additional justification for European society’s changing perception of race. The elite Anglicized Indians had not only dared to challenge British authority and administrative processes, but they had dared to utilize their Western teachings to do so.
